1. Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of EnglishNest (the "Service"), an IELTS vocabulary learning application. By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
EnglishNest is an independent study tool. "IELTS" refers to the exam this Service helps you prepare for; we are not affiliated with, endorsed by, or sponsored by IDP IELTS, the British Council, Cambridge Assessment English, or any official administrator of that exam.
2. Eligibility and accounts
If you are under 16, you may only create an account with the knowledge and consent of a parent or legal guardian, who is responsible for supervising your use of the Service. Every new account is reviewed manually before it can be used (typically within 24 hours); we may approve, reject, or later suspend an account at our discretion, including for violation of these Terms. You are responsible for keeping your password confidential and for all activity under your account.
3. Your content
"Your Content" means anything you add to the Service — custom word lists, notes, flags, reading passages you paste in for extraction, feedback submissions, and similar. You keep ownership of Your Content. By submitting it, you grant us a limited license to store, process, and display it back to you (and, where you choose to share one of your lists with another user, to that user) solely to operate the Service. Personal notes, flags, and mastery progress you attach to a word are private to your account and are not shown to other users, even on a shared list.
You're responsible for Your Content and confirm you have the right to submit it (for example, a reading passage you paste in should be text you're entitled to use for personal study).
4. Our intellectual property
Except for Your Content, the Service — including its software, design, curated system word lists, and the EnglishNest name and logo — is owned by us and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your own personal study; outside of that, you may not copy, modify, reverse-engineer, or redistribute it.
5. AI-generated content
Some features (word meanings, example sentences, IPA, collocations, difficulty suggestions, reading-passage extraction) are generated using a third-party AI model (currently Google Gemini — see Privacy Policy for what's sent to it). AI output can be inaccurate or inappropriate for a specific exam context. It's provided for study assistance only, not as a guaranteed-correct reference — verify important meanings against a dictionary before relying on them, particularly ahead of an actual exam.
6. Acceptable use
You agree not to:
- Use the Service for anything unlawful, or to submit content that is illegal, infringing, or abusive;
- Attempt to bypass account approval, security measures, or usage limits (including automated/AI-usage quotas);
- Scrape, resell, or redistribute system word lists or Service content in bulk without permission;
- Interfere with the Service's normal operation or other users' access to it.
7. Service availability
The Service is provided on an "as is" and "as available" basis. We don't guarantee uninterrupted or error-free operation, and features may change or be discontinued. AI-dependent features additionally depend on a third-party provider's availability and are subject to daily usage quotas.
8. Disclaimer and limitation of liability
To the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, and we are not liable for indirect, incidental, or consequential damages arising from your use of it, including reliance on AI-generated study content. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
9. Indemnification
You agree to indemnify and hold us harmless from any claim, loss, or expense — including reasonable legal fees — arising from Your Content, your violation of these Terms, or your misuse of the Service.
10. Termination
You may stop using the Service at any time; contact us to request account deletion. We may suspend or terminate an account that violates these Terms, is inactive for an extended period, or was never approved. We may also discontinue the Service, or any part of it, at any time; where practical, we'll give you reasonable notice first.
11. Changes to these terms
We may update these Terms from time to time; the "Last updated" date above will change accordingly. Material changes will be highlighted at your next login where practical. Continued use after a change means you accept the updated Terms.
12. General
If any provision of these Terms is found unenforceable, the rest remain in full effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service, and supersede any prior agreement on the same subject.
